Résumé :

Pour le « nouveau médecin vasculaire libéral interventionnel », la mise en oeuvre d’un traitement thermique endoveineux (TTEV) ne se résume pas à une chirurgie rapide.
Un TTEV est une chirurgie ambulatoire organisée, soumise à autorisation de l’ARS et à des contraintes fortes de fonctionnement et à des moyens réglementaires.
Ces contraintes ont pour but de garantir la qualité de la prise en charge, la sécurité du patient et la maîtrise des dépenses de soins. Face à ces exigences, les responsabilités du « médecin vasculaire libéral interventionnel » tant médicales qu’organisationnelles sont accrues.
En pratique, nonobstant ses responsabilités économiques de médecin traitant, le « médecin vasculaire libéral interventionnel » pour son activité de chirurgie ambulatoire a des obligations identiques à celles d’un chirurgien exerçant dans un établissement de santé, ce qui lui impose des obligations en termes de fiabilité, de sécurité et de qualité des soins.

Durant toute la durée de son activité chirurgicale ambulatoire, le « médecin vasculaire libéral interventionnel » n’aura de cesse de se prémunir des risques d’évènements indésirables et de leurs
conséquences juridiques, tout en s’assurant de la viabilité de son activité, voire de sa rentabilité.
Le choix de la structure au sein de laquelle il pratiquera un TTEV n’est donc pas anodin. Si son choix s’oriente vers une structure de chirurgie ambulatoire externe, un travail important de compréhension, d’adaptation et de complémentarité entre sa propre organisation et celle de l’établissement d’accueil est nécessaire.
Ce travail organisationnel et les obligations de surveillance de toute la chaine thérapeutique qui incombe au médecin vasculaire libéral interventionnel ne doivent pas être pris à la légère, car les conséquences financières voire juridiques, (en cas de faute avérée et même si l’établissement de santé pourrait en être la véritable cause) peuvent être très graves.

Summary :

For an “interventional vascular physician „the implementation of endovascular thermal treatment” (EVTT)
is not just a matter of quick and ambulatory procedure.
(EVTT) is organized for outpatient surgery, whigh is subject to an authorization of the regional health agengy and to strong operating constraints and regulatory means.
The aim of these constraints is to guarantee the quality of care, the safety of the patient and the control of care expenses.
Faced with these demands, the medical organizational responsibilities of the “new interventional liberal vascular physician” are increased.
In practice, notwithstanding his economic responsibilities as a treating physician, the “new interventional liberal vascular physician” has the same obligations as a classical surgeon practicing in a healthcare establishment, which imposes obligations on his reliability, safety and quality of care.

Throughout the duration of its ambulatory surgical activity, the “new interventional liberal vascular physician” will constantly protect himself against the risks of undesirable events and their legal consequences, while ensuring the viability of his activity, of its profitability.
The choice of the structure within which he will practice EVTT is therefore not insignificant. If the patient chooses an outpatient surgical structure, an important job of understanding, adapting and  complementing his own organization and that of the host institution, is required.
This organizational work and the monitoring obligations of the entire therapeutic chain which is the responsibility of the “newinterventional liberal vascular physician”should not be taken lightly, as the financial or even legal consequences (in case of proven fault and even if the health facility could be the real cause), can be very serious.
